PRIVACY STATEMENT Live Web Host understands the importance of protecting personal privacy and is committed to protecting its customers' privacy. Live Web Host only uses the information from customers to correctly process orders. Live Web Host's privacy policy applies only to Live Web Host and not product suppliers outside of Live Web Host who may be associated with the purchase transaction. DESCRIPTION OF INFORMATION COLLECTED AND USAGE Live Web Host stores the information that is provided by the customer when a customer makes a purchase from Live Web Host. Live Web Host only needs a name, email address, postal address, and credit card information to process orders. When a customer places an order, Live Web Host may also collect information on a customer communicated the order to Live Web Host (email, phone order, fax, etc.). Live Web Host collects this information so that we have alternate ways of communicating with you should the information you provided be inadequate. Communication information can include: an internet address, language preference, browser type, currency type, whether a secure or insecure web page was utilized, return email address shown in your email messages, the return address on envelopes, the fax number on faxes, the phone number from which a customer called and any other information that might help us to contact a customer that might be included with payment. Live Web Host also reserves the right to provide aggregate information about site usage and traffic patterns, stripped of any individual identification, to third parties for marketing research and to comply with various reporting requirements. INFORMATION COLLECTED FOR INTERNAL FEEDBACK Live Web Host reserves the right to aggregate the data collected and use it for market research purposes in order to improve Live Web Host's customer service and products. This aggregated data will not include information that would personally identify a customer. POLICIES REGARDING THIRD PARTIES Live Web Host's policy is not to sell, rent or trade personal information to others not associated with a purchase transaction; however, Live Web Host reserves the right to do so in the future. If Live Web Host does decide to do this, Live Web Host will email each customer and give each customer 30 days to inform us if he/she wishes for their information to remain private. Customers with concerns about disclosing personal information to parties may send Live Web Host an email to sales@livewebhost.com. TERMS OF SERVICE Live Web Host, Inc provides World Wide Web page hosting. Live Web Host, Inc reserves the right to suspend or cancel a customer's access to any or all services provided by Live Web Host, Inc when Live Web Host, Inc decides that the account has been inappropriately used or otherwise. Live Web Host, Inc reserves the right to scan our servers for any material that is not aceptable as described below. CONTENT Live Web Host do not allow any of the following content to be stored on its servers: Illegal Material - This includes but not limited to, copyrighted works, commercial audio, video, or music files, and any material in violation of any Federal, State or Local regulation. Adult Material - Includes, but not limited to, all pornography, erotic images, or otherwise lewd or obscene content. The designation of "adult material" is left entirely to the discretion of Live Web Host. Warez - Includes, but not limited to, pirated software, ROMS, emulators, phreaking, hacking, and password cracking. IP spoofing, etc., and encrypting of any of the above. Also includes any sites which provide "links to" or "how to" information about such material. UNLIMITED USE POLICY High bandwidth usage: Live Web Host, Inc offers an unlimited use policy by maintaining very large ratios of bandwidth per customer. In cases, Live Web Host, Inc may find a customer to be using server resources to such an extent that he or she may jeopardize server performance and resources for other customers. In such instances, Live Web Host, Inc reserves the right to impose the High Resource User Policy for the consideration of all customers. HIGH RESOURCE USER POLICY Resources are defined as bandwidth and/or processor utilization. Live Web Host, Inc may implement the following policy to its sole discretion: When a website is found to be monopolising the resources available Live Web Host, Inc reserves the right to suspend that site immediately. This policy is only implemented in extreme circumstances and is intended to prevent the misuse of our servers. Customers may be offered an option whereby Live Web Host, Inc continues hosting the website for an additional fee. PAYMENT POLICIES All accounts are set up on a prepay basis. Live Web Host, Inc reserves the right to change prices of accounts or services at any time. The account is considered open when Live Web Host, Inc issues a domain control panel to the customer. Customers are reminded to ensure that the domains to be hosted are registered and that the DNS were changed to as specified. Payment is due each anniversary year following the date the account was established. Customers will receive an email requesting payment one month before the due date. If no corresponance or payment is received 2 days before the anniversary of the account being opened, the account will be suspended and all contents stored on our servers will be deleted on the anniversary day of the account being opened. No bills or invoices will be sent by regular mail. All invoices will be sent directly to customers via email shortly after payment has been received. All payments are in US Funds. PAYMENT OPTIONS In order to streamline our accounting procedures and keep costs down Live Web Host, Inc runs a limited number of payment options. Credit / Debit Cards: Live Web Host, Inc accepts Visa, MasterCard, American Express, and Discover. Check Payment: This option is available to customers who pay annually for their Live Web Host, Inc account. A credit card number will still be required if customers require the facility to purchase optional services after the main account is setup. Live Web host, Inc cannot guarantee that a service will be provided until after any received checks have been cleared. DOMAIN HOSTING Once a domain is hosted on our servers, it will not be removed until the account has expired or the account has been cancelled. 14 DAY TRIAL For customers opening their first account the initial 14 days are available on a trial basis. Customers will not be entitled to this benefit if they have previously had an account with Live Web Host, Inc unless the period of absence has been greater than one year. New customers will not be entitled to a trial period if any account has previously been created at the same postal address within the same 12 month time span. CANCELLATION AND REFUNDS Live Web Host, Inc reserves the right to cancel the service at any time. In this event customers will not be entitled to a refund. If a customer contravenes Live Web Host, Inc' terms of service a refund will not be issued in the event of a cancellation. Customers may cancel their account at any time. During the initial trial period customers who wish to cancel will be entitled to a refund for their hosting fees minus any money used to setup a control panel the money used to to setup any extra services will not be refunded. Any incentives offered to customers when opening the account will also be cancelled. Customers may be given the option to purchase services which were offered as start-up incentives in the result of a cancellation. Once the initial trial period has expired customers are not entitled to receive a refund. In addition some accounts incur set-up fees, these charges are also non-refundable. INDEMNIFICATION Customer agrees that it shall defend, indemnify, save and hold Live Web Host, Inc harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against Live Web Host, Inc, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless Live Web Host, Inc against liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with Live Web Host, Inc' server; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement and (4) any defective products sold to customer from Live Web Host, Inc server. DISCLAIMER Live Web Host, Inc will not be responsible for any damages your business may suffer. Live Web Host, Inc makes no warranties of any kind, expressed or implied for services we provide. Live Web Host, Inc disclaims any warranty or merchantability or fitness for a particular purpose. The includes loss of data resulting from delays, nondeliveries, wrong delivery, and any and all service interruptions caused by Live Web Host, Inc and its employees.
